Terms of Service — Bidsmith

1. Acceptance of Terms

By accessing or using Bidsmith ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Bidsmith is an AI-powered proposal generation tool that helps freelancers and agencies create professional proposals. The Service includes proposal generation, hosting of shareable proposal links, and related analytics features.

3. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. Subscriptions and Billing

Bidsmith offers free and paid subscription plans. Paid subscriptions are billed monthly through our payment processor, Paddle. By subscribing to a paid plan, you authorize recurring charges. You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period.

5. User Content

You retain ownership of all content you submit to the Service, including client briefs, proposals, and portfolio materials. By using the Service, you grant Bidsmith a limited license to process your content solely for the purpose of providing the Service. We do not sell, share, or use your content for training AI models.

6. AI-Generated Content

Proposals generated by the Service are created using artificial intelligence. You are responsible for reviewing, editing, and verifying all AI-generated content before sharing it with clients. Bidsmith does not guarantee the accuracy, completeness, or suitability of generated proposals.

7. Acceptable Use

You agree not to use the Service to: generate fraudulent, misleading, or deceptive proposals; violate any applicable laws or regulations; infringe upon the rights of others; transmit malware or harmful code; or attempt to gain unauthorized access to the Service.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, Bidsmith shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
